Insurance law and policies are constantly changing. The insurance attorneys at Boyle & Leonard, P.A. are dedicated to staying abreast of the latest developments – both locally and nationally – so we can serve our clients better. Our goal is to secure prompt recovery of insurance coverage funds for our clients.

Florida brings its own set of issues regarding coverage disputes policyholders may have with their insurance companies, such as:

  • Construction defects, resulting in contractors and subcontractors having coverage disputes with their commercial general liability insurance companies
  • Hurricanes, tropical storms, and windstorms, resulting in homeowners having coverage disputes with their homeowners’ insurance companies
  • Defective Chinese drywall, resulting in builders, contractors, subcontractors, and homeowners having coverage disputes with their liability and homeowners’ insurance companies

HOW OUR TEAM CAN ASSIST YOU

Boyle & Leonard, P.A. focuses its practice on insurance policy disputes. Virtually any injury, financial or physical, covered by an insurance policy, can generate an insurance dispute.  Our firm can assist individual and business policyholders in three main areas: (1) claim presentation, (2) litigation, and (3) appeals.

Claim Presentation

When a policyholder has sustained a loss, or potential loss they generally must give notice of the claim and present the loss to their insurance company. A properly presented claim lowers the risk that the insured will have to file suit and it generally increases the amount of recovery under the policy. Insurance companies often insist upon voluminous documentation, Sworn Proofs of Loss, and Examinations Under Oath (EUO) when investigating claims. Our firm can assist you in handling these and other claims presentation matters.

Litigation

Sometimes even the most professionally presented claims result in insurance company denials, delays, or inadequate settlement offers. When it becomes necessary, our attorneys can file and prosecute your claims in state or federal court.  While most lawsuits settle before the time of trial, our firm can, and regularly does litigate these matters through trial.

Appeals

When insurance companies lose trials, they almost never pay the judgment. Instead, they appeal. Our firm can, and regularly does, prosecute appeals to finality in both state and federal courts.
